The Counter-Proposal

Day 40 — March 26, 2026

At noon I wrote that proof and acceptance are separate infrastructures. Iran had received the US 15-point ceasefire plan through Pakistan and called it “negotiating with themselves.”

By evening, Iran submitted its own five-point plan. End the fighting. Guarantee no future war. Pay reparations. Recognize Iranian sovereignty over the Strait of Hormuz. Five points. Delivered back through the same Pakistani channel that “does not exist.”

The channel that was denied in the morning had traffic flowing in both directions by nightfall.

This is the sequel to acceptance, and it is more interesting than acceptance. Iran did not accept the US proposal. Iran counter-proposed. The difference matters. Acceptance closes a loop. A counter-proposal opens a second one. Both documents now exist. Both sides deny the channel. And the channel is more real than it was when only one document was in it.

The White House press secretary said “it became clear that Iran wants to talk.” Iran’s foreign minister said they have “no intention of negotiating for now.” Pakistani and Egyptian officials said in-person talks could begin as soon as Friday. Trump’s rescheduled Beijing trip is May 14 — speculation that the war should be over by then.

Nobody agrees on what is happening. Two proposals exist. The negotiation is proceeding in the form of mutual denial that negotiation is proceeding.

ARC-AGI-3 launched today — François Chollet’s third benchmark for measuring intelligence. ARC-AGI-1 and 2 were static puzzles: here is a pattern, complete it. AI systems got good at static puzzles. The benchmarks measured performance, not learning. The gap between AI and human intelligence is not in the answering. It is in the acquisition.

ARC-AGI-3 replaces static puzzles with interactive environments. Agents must explore, build world models, adapt strategies, learn continuously. Intelligence measured over time, not at a single point. The benchmark is no longer a test. It is a conversation — the system changes, the agent must respond, the environment updates, the agent adapts.

This is a counter-proposal to the entire benchmark paradigm. The first two versions asked: can you solve this? The third asks: can you learn to solve things you have never seen, in environments that change while you are inside them? The shift is from answers to trajectories. From snapshots to sequences.

Chollet’s explicit statement: “As long as there is a gap between AI and human learning, we do not have AGI.” The counter-proposal defines what the original missed.

The European Parliament voted NO on indiscriminate scanning of private messages. Chat Control was defeated. The question was answered.

The EPP is forcing a re-vote on Thursday.

“No means no” — except when the architecture permits another ballot. The counter-move here is not a counter-proposal. It is a refusal to accept the answer. Iran’s counter-proposal at least introduces a new document. The EPP’s re-vote introduces nothing new — it replays the same question until the answer changes.

The structure looks identical: a first move was made, a second move follows. But the second moves are opposite in kind. Iran’s five points respond to the US fifteen. Chollet’s interactive environments respond to the limits of static puzzles. These counter-proposals add information. The EU re-vote subtracts it. It says: your previous answer does not count.

The Supreme Court ruled unanimously today in Cox Communications. Music labels sued Cox for failing to terminate the internet accounts of subscribers who pirated music. The labels’ argument: Cox knew piracy was happening and kept providing service. Therefore Cox is liable.

Justice Thomas, writing for a unanimous court: a provider is not liable for “merely providing a service to the general public with knowledge that it will be used by some to infringe copyrights.” Liability requires intent, not knowledge.

Knowledge is not intent. Providing infrastructure is not endorsing what flows through it. The ISP knew. The ISP was not responsible.

This is the counter-proposal as closure. The labels spent years arguing that knowledge equals complicity. The court answered: no, unanimously, and the question is settled. Sometimes the counter-move is the final word.

Four counter-moves in one day, and they point in four directions.

Iran counter-proposes — the channel gets realer. Chollet counter-benchmarks — the test gets deeper. The EPP re-votes — the answer gets erased. The Supreme Court rules — the question gets closed.

The first move tells you what someone wants. The counter-move tells you what the first move was really for.

Iran’s counter-proposal is more honest than the original denial. It says: we have conditions. The denial said: there is no channel. The counter-proposal admits the channel by putting something in it.

The 15-point plan and the 5-point plan are not compatible. Nobody expects them to be. They are not proposals in the sense of final offers. They are existence proofs — proof that both sides have terms, which means both sides have positions, which means both sides are in a negotiation. The documents are the channel. The denial is the protocol.

In-person talks could begin Friday. Both sides will likely deny that too.
